Amendment to Plat Procedure
for the
Combination of Two or More Platted Lots within Comal County, Texas

When a property owner owns two or more contiguous platted lots and wishes to combine said lots into a single lot, the owner may either replat the property or follow this Amendment to Plat Procedure.

|
- The County reserves the right to require a replat in situations
where the County determines that a replat would be most appropriate.
- The property shall be lots or tracts which have been created
by the filing and recording of a plat which is currently on record
with the Comal County Clerk in the Map and Plat Records.
- The lots or tracts shall exist in their current platted configuration
as shown on a recorded plat on file with the Comal County Clerk.
Lots or tracts that have been subdivided, reconfigured, amended,
corrected, or otherwise modified without being approved by the
Comal County Commissioners Court and filed for record with the
County Clerk shall not be eligible for this procedure.
- The amendment to Plat is only intended to combine the lots or
tracts. The Amendment to Plat shall not affect the dimensions
of the overall boundary, building setbacks, easements, notes,
restrictions, or any other provision as shown on the recorded
plat.
- All required documents as listed below shall be submitted.
Comal County shall not begin processing the Amendment to Plat
until all required documents have been received by the County
Engineer.

The property owner shall submit the following documents to the County Engineer for the Amendment to Plat Procedure:
- Completed Amendment to Plat form. The form includes:
- date
- Owner(s) name
- Owner's Mailing Address
- Legal Description of Property
- Resultant Lot or Tract Number
- Lienholders Statement
- Leinholders Signature(s)
- Owners Signature(s)
- Notary Public Acknowledgment
- Copy of the recorded plat. Copies of recorded plats are available
at the Comal County Clerks Office.
- Copies of the recorded deeds indicating current ownership of
the lots or tracts. Copies of recorded deeds are available at
the Comal county clerks Office.
- Tax Certificates form the Comal County Tax Assessor/Collector
indicate that the County taxes on the lots or tracts are current
and have been paid.
- Submit appropriate filing fee for the recording of the Amendment
to Plat in the Real Property Records by the Comal County Clerk.
- Optional: Comments/releases form all affected public
utilities or the holder of any other easement within the lots
or tracts.

The review and approval process shall be as follows:
- The County Engineer shall receive the required documents and
recording fee(s). The County Engineer shall review the submittal
for completeness and ensure that all required documents have been
received.
- The proposed Amendment to Plat shall be sent to the appropriate
County Commissioner for placement on the Commissioners Court agenda
to be considered for approval.
- Upon approval by the Commissioners Court, the County Clerk shall
accept the fee and record the Amendment to Plat in the Real Property
records and reference the Amendment to Plat in the Map and Plat
Index.
